1. RENTAL PERIOD: This agreement is for a short-term rental not exceeding 14 days, in accordance with IRC §280A(g). The rental period begins at 3:00 PM on the check-in date and ends at 11:00 AM on the check-out date, unless otherwise agreed in writing.
2. PAYMENT TERMS: Total rent, cleaning fee, and security deposit must be paid in full at least 7 days prior to check-in. Payment shall be made via check, wire transfer, or other mutually agreed method. Late payments may result in cancellation of the reservation.
3. SECURITY DEPOSIT: The security deposit will be held to cover any damages beyond normal wear and tear. The deposit will be returned within 30 days after check-out, less any deductions for damages, excessive cleaning, or unpaid charges. Owner will provide an itemized statement of any deductions.
4. OCCUPANCY LIMITS: The property shall accommodate no more than the stated number of guests. No additional persons may stay overnight without prior written approval. Violation may result in immediate termination and forfeiture of all payments.
5. USE OF PROPERTY: The property is to be used exclusively for residential purposes. No commercial activities, parties, events, or gatherings exceeding the maximum occupancy are permitted. Smoking is prohibited inside the property. Pets are not allowed unless specifically authorized in writing.
6. CONDITION OF PROPERTY: Renter acknowledges receiving the property in good, clean, and safe condition. Renter agrees to maintain the property in the same condition and return it clean and undamaged, normal wear and tear excepted. Any damages must be reported immediately to the owner.
7. CANCELLATION POLICY: Cancellations are subject to the following terms: (a) More than 30 days before check-in: Full refund minus 10% processing fee; (b) 15-30 days before check-in: 50% refund; (c) Less than 15 days before check-in: No refund. Security deposit is always non-refundable if cancellation occurs.
8. OWNER'S RESPONSIBILITIES: Owner shall provide the property in a clean, safe, and habitable condition with all advertised amenities in working order. Owner is responsible for repairs due to normal wear and tear or mechanical failures, but is not liable for failures beyond their control.
9. LIABILITY AND INSURANCE: Owner is not liable for any injuries, accidents, damages, or losses to persons or property during the rental period. Renter is responsible for obtaining their own liability and personal property insurance. Renter agrees to indemnify and hold harmless the owner from any claims arising from renter's use of the property.
10. RULES AND REGULATIONS: Renter agrees to comply with all HOA rules, community regulations, local ordinances, and state laws. Quiet hours are from 10:00 PM to 8:00 AM. Trash must be properly disposed of in designated receptacles. Parking is limited to designated areas only.
11. RIGHT OF ENTRY: Owner reserves the right to enter the property with 24 hours notice for inspections, repairs, or showings, except in case of emergency.
12. TERMINATION: Owner may terminate this agreement immediately for violation of any terms, with no refund due to renter. Renter must vacate within 2 hours of notice.
