Understanding Average Rental Period

≤ 7 Days Average:

āœ“ NOT a passive activity
āœ“ No Real Estate Professional status required
āœ“ Only need material participation (one of 7 tests)
āœ“ Losses can offset ordinary income if materially participating

8-30 Days Average with Substantial Services:

āœ“ NOT a passive activity if substantial services provided

āœ“ Must document substantial services (daily cleaning, concierge, meals, etc.)

Material Participation Tests

Seven Tests for Material Participation (IRC §469(h))

You only need to meet ONE test per property. No Real Estate Professional status required for STRs ≤7 days.

  1. Test 1 - 500+ Hours: You participate in the activity for more than 500 hours during the year.
  2. Test 2 - Substantially All: Your participation constitutes substantially all of the participation in the activity.
  3. Test 3 - 100+ Hours & No One Else More: You participate more than 100 hours and at least as much as any other individual.
  4. Test 4 - Significant Participation: Activity is "significant" (100-500 hrs) and total of all such activities exceeds 500 hours.
  5. Test 5 - Prior 5 of 10 Years: You materially participated for any 5 of the prior 10 tax years.
  6. Test 6 - Personal Service Activity: Personal service activity and you materially participated for any 3 prior years.
  7. Test 7 - 100+ Hours & Facts/Circumstances: You participate more than 100 hours on a regular, continuous, and substantial basis. (Cannot use if anyone is paid to manage OR anyone spends more hours managing than you.)
